3 Policies of anti Hazing Law

The Chancellor of Higher Education includes in his annual report to the Governor and the Legislative Assembly, in accordance with N.J.S. 18A: 3-21, a section detailing the extent of violence and pollution in higher education, explaining the measures taken to address the problem and making recommendations to mitigate the problem. The school board and the school`s board of directors or senior administrator will ensure that students are informed of the anti-hazing policy, including the rules, penalties and enforcement program under the policy. Any violation of this policy will be considered a violation of the Ursinus College Code of Conduct, college policies and/or related applicable laws. All allegations of hazing, aggravated hazing or organizational hazing and all related reprisals will be investigated by the College. 2.

Each independent public higher education institution shall issue a written policy against harassment and, in accordance with this policy, adopt rules prohibiting students or other persons associated with an organisation that is under the sanction of an organisation or recognised as such by the institution from engaging in harassment. The university publishes the policy in a publicly accessible place on the institution`s website and provides each organization within the institution with a copy of the policy, including the institution`s rules, penalties and enforcement program. The Anti-Hazing Act of 1995, officially known as Republic Act No. Designated in 8049, is a Philippine law that regulates hazing actions and other initiation rites in the country`s brotherhoods and sororities. It prohibits and punishes physical harm and violence in such practices. Hazing is a third-degree crime when an actor commits an act prohibited in paragraph a. of this article, which results in the death or serious bodily injury of another person and constitutes a fourth-degree crime if the actor commits an act prohibited in paragraph A. of this article that results in bodily harm to another person. Otherwise, hazing is a crime.

a) «Hazing» means committing an act against a student or forcing a student to commit an act that poses a significant risk of harm to a person in order for the student to be initiated into or associated with a student organization. 4. a. Each public and independent college maintains a report that includes information on any violations of the institution`s anti-hazing policy and federal and state hazing laws that are reported to the institution. Information relating to a reported infringement shall be kept by the institution for five years. The Chancellor of Higher Education sets standards and promulgates rules and regulations to monitor the incidence of violence and harassment in New Jersey colleges, and establishes a unified system of records to gather information about these crimes. For the purposes of this Act, «violence» means any crime against a person or property that creates a risk of bodily harm. S.1982, c.

In addition to any other sanction or penalty that may be imposed, a student, fraternity or college described in paragraph a. of this section shall be fined at least $1,000 or more than $5,000 for an initial violation of paragraph a. of this section and a fine of not less than $5,000 or more than $15,000 for each subsequent violation. Each school board issues a written policy that regulates bullying of students or staff. The policy must apply to student behaviour that occurs on or off school grounds and during and after school hours. The directive must include reporting procedures and disciplinary consequences in case of breach of the directive. Disciplinary consequences must be serious enough to deter violations and adequately discipline prohibited behaviour. Disciplinary consequences must be in accordance with sections 121A.41 to 121A.56.

Each school must include the policy in the Student Manual on School Policy. Any person held liable for the violation of the provisions of this policy may be subject to disciplinary action up to and including dismissal and/or dismissal from the College in accordance with the College`s policies and procedures. Ursinus College requires that all responsible staff (i.e., all faculty and staff) who believe they have witnessed conduct that constitutes hazing, aggravated hazing, or organizational hazing in violation of this policy report the violation to the Dean of College Students. Ursinus College also encourages all other members of the Ursinus community who believe they have witnessed behavior that hazing, aggravated hazing, or organizational hazing in violation of this policy constitutes, has experienced, or is aware of to report the violation to the Dean of College Students. If an employee, student or community member has questions about what constitutes hazing under this policy, they are encouraged to contact their supervisor, the Director General of Compliance and Community Standards/Title IX Coordinator and/or the College`s Vice-President and General Counsel for advice. (a) have called 9-1-1 or otherwise communicated with campus security, police or emergency services and reported that a person required medical assistance as a result of an act of harassment described in this section; b. The Academy develops and implements a certification program for school safety specialists. A school safety specialist appointed in accordance with § 2 of this Act must obtain certification. The certification program offers free training to newly appointed school safety specialists in the areas of bullying, hazing, absenteeism, internet safety, emergency planning, emergency drills, drugs, weapons, gangs, and school policing, as well as any other areas deemed necessary by the Academy. The academy also offers annual training for certified school safety specialists. The Academy develops training modules in traditional and online formats.

Any student, student organization, team or other person associated with a student organization held responsible for hazing, aggravated hazing or organizational hazing under this Policy, whether on or off campus, may be subject to disciplinary action by the College and may also be prosecuted under state law; including Timothy J. Piazza Antihazing Law, 18 Pa. C.S. § 2801, et seq. Any employee of a higher education institution who observes or has direct knowledge of a participant or victim of an act of violence or harassment must, in accordance with the standards set by the Chancellor, submit a report describing the incident to the Director General of the institution in the manner prescribed by the Chancellor, and a copy of the report will be transmitted to the State Department of Higher Education. A policy adopted under section 2 of P.L.2021, c.208 (C.18A: 3-27.2) applies to any action performed on or off campus if the acts are considered harassment. S.2021, c.208, p.3. 3. The Bill of Rights established by the Attorney General under section 2 of P.L.1991, c.388 (C.18A:3-25) contains information on the criminal penalties for hazing and aggravated turbidity established pursuant to P.L.1980, C.169 (C.2C:40-3 et seq.). The education officer shall maintain and provide school boards with a model disability policy for students or staff that meets the requirements of paragraph 3. Ursinus College adheres to the Timothy J. Piazza Anti-Hunting Act, which defines hazing, including: hazing, aggravated hazing, and organizational hazing, each of which is prohibited by Ursinus College guidelines. It is not a defence that the consent of the minor or student has been obtained or obtained.

Nor is it a defense that the conduct has been sanctioned or approved by the organization. Ursinus College will report on any violations of this policy or federal or state laws related to hazing that are reported to the College.
